THIS NOTICE DESCRIBES HOW HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Who we are
Procreate Foundation is a not-for-profit 501(c)(3) organization (Tax ID 84-4318313) located at 700 Oak Grove Road, Chesapeake, VA 23320. We provide financial assistance grants to individuals and families undergoing fertility treatment. To evaluate a grant application we receive health information about you, including your infertility diagnosis, your treatment plan and a letter from your treating provider. We protect that information following the standards of the Health Insurance Portability and Accountability Act (HIPAA) and Virginia law.
How we use and disclose your health information
- Grant evaluation. We use the information in your application package to determine eligibility, review your case and decide on the award.
- Coordination with your treating clinic. With your application you authorize us to confirm your diagnosis, treatment plan and itemized costs with the fertility specialist who signed your provider letter, and to pay approved grants directly to that clinic.
- Operations. We may use de-identified or aggregated information (no names, dates or other identifiers) for reporting to our board, donors and the IRS.
- As required by law. We will disclose information when required by federal, state or local law, including to the U.S. Department of Health and Human Services when it reviews our compliance.
- Service providers. We store application files and email on Amazon Web Services and Google Workspace. Both providers have signed a Business Associate Agreement with us.
Any other use or disclosure, including testimonials, success stories or photographs, will be made only with your separate written authorization, which you may revoke at any time in writing.
Your rights
- Access. You may request a copy of the health information we hold about you.
- Amendment. You may ask us to correct information you believe is inaccurate or incomplete.
- Restrictions. You may ask us to limit how we use or share your information. We will consider every request, but we are not required to agree unless the law requires it.
- Confidential communications. You may ask us to contact you in a specific way or at a specific address.
- Accounting of disclosures. You may request a list of the disclosures we have made of your information other than for grant evaluation or as authorized by you.
- Paper copy of this notice. You may request a paper copy at any time, even if you agreed to receive it electronically.
- Breach notification. We will notify you if a breach occurs that may have compromised the privacy or security of your information.
